We are the data controller (in Canada: the organization responsible) for this information.

1. Summary
- We collect what we need to sell you a license, deliver it, keep it working and support you.
- We do not receive your website visitors’ chat conversations. The Software runs on your own server and sends questions to the AI provider you configure with your own API key (see section 6).
- We do not sell your personal information and do not use it for advertising profiles.

We do not knowingly collect information from children. Our Services are intended for businesses and people aged 18 or over.
3. Emails we send
We send emails that are necessary for your purchase and license: order confirmations and invoices, your license key, trial emails, reminders before a license or trial expires, renewal and payment notices, and important changes to our Terms. These are service emails and are part of providing the Services. [We do not send marketing emails. / We send product news only if you opt in, and every such email has an unsubscribe link.]
4. Who we share information with
We share personal information only with service providers that help us run the Services, under contracts that require them to protect it and use it only on our instructions, and when required by law:
- Payment providers: Stripe ([Stripe, Inc. / Stripe Payments Europe Ltd.]) and PayPal, to process payments. They act as independent controllers for some processing, under their own privacy policies.
- Hosting: Hostinger USA hosts the Website, our database and the license server.
- Email delivery: Amazon Webservice Canada, to deliver our emails.
- AI provider for the chat on our Website: OpenAI, L.L.C. (USA) processes the questions you type into the chat on answerkite.com, together with parts of our Website content, to generate answers. Under OpenAI’s API terms, API data is not used to train their models by default.
- Envato, only if you activate with an Envato purchase code, to verify the purchase.
- [Google Fonts]: if enabled, your browser loads fonts from Google’s servers, which receive your IP address. [Remove this item if you turn off “Load Inter Plus Jakarta Sans from Google Fonts” in the theme settings – recommended for EU visitors.]
- Professional advisers and authorities (accountants, lawyers, tax authorities) where needed to meet legal obligations or defend legal claims, and a buyer of our business if it is sold (you will be informed).
We do not sell or rent personal information, and we do not “share” it for cross-context behavioural advertising as defined by California law.
5. International transfers
We are based in Canada. Some service providers process data in other countries, including the United States. Where personal data from the European Economic Area, the UK or Switzerland is transferred to countries without an adequacy decision, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses (and the UK Addendum), or the EU–U.S. Data Privacy Framework where the recipient is certified. [Canada has an EU adequacy decision for commercial organisations subject to PIPEDA.] You can ask us for a copy of the relevant safeguards.
6. The Software on your website (your visitors’ data)
When you install the Software on your own website, it runs on your server. Your visitors’ names, email addresses and chat messages are stored in your website’s database and sent to the AI provider using your API key. We do not receive, store or have access to these conversations. For that data you are the controller and your AI provider is your processor; please describe it in your own privacy policy. The only data the Software sends to us is the license data described in section 2 (license key, domain, installation ID, version), which does not include information about your visitors.
7. How long we keep information
- Orders, invoices and payment records: [7] years, as required by tax and accounting law.
- Account and license data: while your account or license is active, and for [3] years after it ends, so we can handle renewals, questions and legal claims. You can ask us to delete your account earlier (see section 9), subject to legal retention duties.
- Free trial records (name, email, trial key, websites used): [24] months after the trial ends, to allow only one trial per person and website.
- Conversations in the chat on our Website: [90] days after the last message, then deleted automatically.
- Support emails: [3] years.
- Hashed IP addresses used for rate limiting: up to 1 hour.
8. Security
We protect personal information with appropriate technical and organisational measures, including encrypted connections (HTTPS), access controls, digitally signed license responses and limited access to our systems. No method of transmission or storage is completely secure; if a breach affects your personal information, we will notify you and the authorities as required by law.
9. Your rights
Depending on where you live, you have rights over your personal information, including the right to:
- access it and receive a copy (including in a portable format);
- correct inaccurate information;
- delete it (subject to legal retention duties);
- restrict or object to certain processing, including processing based on legitimate interests;
- withdraw consent where we rely on consent (without affecting earlier processing);
- in California and other US states: know what we collect, delete, correct, and opt out of sale or sharing (we do not sell or share), and not be discriminated against for using your rights.
To use your rights, email [email protected]. We reply within the time required by law (usually 30 days) and may need to verify your identity. You can also manage much of your information in My account.
You have the right to complain to a data protection authority: in Canada the Office of the Privacy Commissioner of Canada; in the EU the authority of your country; in the UK the Information Commissioner’s Office. We would appreciate the chance to address your concern first.
[EU/UK representative – only needed if you have no establishment in the EU/UK and regularly sell to people there: “Our representative in the EU under Art. 27 GDPR to be announced. Our UK representative is to be announced.”]
10. Cookies and similar technologies
We use only the cookies and browser storage needed to run the shop, keep you signed in, take payments securely and keep the chat working. Details are in our Cookie Policy.
11. Changes
We may update this Privacy Policy. We will post the new version here with a new date and, for important changes, inform customers by email.
